This Rental Contract dated (the date of this reservation request) sets forth the Terms of Use between: Lessee and FHB Entertainment, LLC., DBA Firehouse Bounce (hereinafter referred to as the “Firehouse Bounce” or “Lessor”) located at: P. O. Box 475, Rockwall, TX 75087 with respect to the rental of certain inflatable equipment identified as: (units specified on reservation request) (hereafter referred to as the “Unit” or “Units”.)
In consideration of the use by Lessee of the Leased Property described above, and for and in consideration of the total rental rate (specified on reservation request) by Lessee to Firehouse Bounce, Firehouse Bounce and Lessee, each intending to be legally bound, agree as follows:
1.) RENTAL TERMS: Firehouse Bounce, agrees to deliver, set up and quality control the Unit(s) to the agreed upon event address as received by Firehouse Bounce from Lessee at or prior to the agreed upon delivery time. Lessee hereby grants unto Firehouse Bounce the right to enter Lessee’s property or designated event site whether Lessee is onsite or not to deliver, set up and/or remove the leased property and to access the necessary peripheral utilities to ensure that Firehouse Bounce equipment is set up per manufacturer’s recommendation. Lessee agrees to inform Firehouse Bounce of any special accommodations necessary for the successful delivery, set up and/or removal of rented inflatable equipment. Lessee indemnifies and agrees to hold harmless Firehouse Bounce from damage to any premises including but not limited to damage to underground sprinkler systems, fence posts, slats or flashing, scratches, dents or other minor cosmetic damage which Firehouse Bounce could not reasonably avoid due to delivery, set up and/or removal of rented inflatable equipment. It is the goal of Firehouse Bounce to arrive at the scheduled event 30 minutes to 1 hour prior to the event start time in order to survey the site, set up on grass, concrete, or indoors only, and quality control the unit(s).
Lessee must ensure that the location on which the unit(s) are to be set up is free and clear of any debris, obtrusive objects and pet waste. Firehouse Bounce will under no circumstances set up in a yard or other area which is primarily used as a pet waste area. Lessee must ensure that any gates, doors, passage ways, etc are at least 36" wide. Firehouse Bounce may need to deliver and set up unit(s) far in advance of the scheduled event start time in order to make all deliveries on time. Firehouse Bounce will contact Lessee to advise Lessee of the advanced delivery time. If Lessee is not on site to receive Firehouse Bounce at the agreed upon delivery time, Firehouse Bounce will move this delivery to the back of the delivery schedule and try again later in the day to make the delivery. Firehouse Bounce cannot wait beyond the agreed upon delivery time as doing so would jeopardize the on-time arrivals of subsequent deliveries. Pick up times may vary. If the scheduled event is at a park or some other public location where the rented equipment is not secure, that pick up will take priority.
Lessee is subject to an additional charge of $40.00 for all service calls due to electricity or preventable occurrences. LESSEE MUST FURNISH ELECTRICAL OUTLET WITH A MINIMUM 20 AMP FUSE CIRCUIT WITHOUT ANYTHING ELSE CONNECTED TO THAT CIRCUIT. LESSEE MUST USE ONLY THE EXTENSION CORDS FURNISHED BY FIREHOUSE BOUNCE AS OTHERS MAY CAUSE THE BLOWER MOTORS TO BURN UP. LESSEE MUST USE ONLY ONE BLOWER PER ELECTRICAL CIRCUIT. FIREHOUSE BOUNCE WILL CONNECT ITS UNITS TO THE OUTLETS SUPPLIED BY LESSEE HOWEVER FIREHOUSE BOUNCE WILL NOT TROUBLESHOOT ANY ELECTRICAL ISSUES RELATED TO POWER. Doing so could jeopardize the on-time arrivals of subsequent deliveries. Lessee must address any electrical or power issues prior to the scheduled event to ensure a seamless delivery.
2.) GENERAL RULES OF OPERATION: Lessee must use the following chart as a reference for maximum participants allowed in the unit(s). a.) Adult Supervision is required at all times. No Exceptions. b.) Flipping, wrestling, rough-housing, running or bullying in the unit(s) is strictly prohibited. c.) Shoes are not allowed inside the unit(s) at any time. d.) Gum, candy, foodstuffs, drinks of any kind, glitter, confetti, sand, mud, cigarettes or any other flammable solid or liquid, dog feces or any other sticky substances are strictly prohibited at any time. (See Rental Contract for cleaning charge.) e.) “SILLY STRING” IS STRICTLY PROHIBITED IN, ON OR IN CLOSE PROXIMITY TO UNIT(S). (See rental contract for Lessee Replacement Cost Liability) f.) All units are properly anchored according to manufacturer’s recommendations at factory anchor points. If the stakes become loose, tighten them down by hammering the head of the spike back into the ground. Should the unit begin to deflate unexpectedly, the first priority is to insure all participants are out safely. After all participants are out safely, check the blower to make sure it is still turned on, check the electrical cord to insure it is still plugged in at both ends, and check the breaker to make sure it did not trip. If you resolve the problem without having to call us, please be sure the unit is completely and properly inflated prior to using again. If the matter or issue cannot be resolved, please call us at 214.729.4991. We will troubleshoot the issue with you over the phone. As a last resort, we will attempt to return to the event to resolve your issue if our schedule allows. If it begins to rain, please ask all participants to exit the unit immediately and turn off the blower. Once the rain has stopped you may reinflate the unit. Be sure that the unit is completed dried off so that it is not slippery. If you are finished using the unit(s) prior to pick up, you may deflate the unit by simply turning off the blower.
3.) Care, Custody and Control: Lessee accepts the herein described equipment and accessories, and Firehouse Bounce acknowledges that it is providing the equipment in good condition at the inception of this lease. Lessee agrees that the term of this lease commences when the herein described equipment is in Lessee's sole care, custody and control and concludes when rented equipment is returned to Firehouse Bounce at the original lease site and all applicable fees are paid in full. If the event site happens to be at a park or other public location, Lessee agrees to remain with rented equipment until such time Firehouse Bounce can arrive to collect rented equipment. Under no circumstances should rented equipment be left unattended. Lessee agrees to return the herein described equipment, together with any and all accessories, at the end of the rental period in the same good condition as when received by Lessee.
Lessee agrees to pay for the repair of damage to or the replacement of any equipment and/or accessories lost or damaged while in the care, custody and control of Lessee or his/her agents. The decision to repair or replace damaged or lost items rests solely with the Firehouse Bounce but in no event shall the repair or replacement costs exceed the replacement value stated by Firehouse Bounce.
Firehouse Bounce has made every effort to briefly demonstrate the function of the herein described equipment. Except if due to the negligence or willful misconduct of Firehouse Bounce, Firehouse Bounce is not responsible for equipment failure due to inadequate knowledge by Lessee or his/her agents. Should a piece of equipment fail to operate properly during the lease period, the Lessee or his/her agents, if possible, should notify Firehouse Bounce at that time, not upon the end of the lease period. Firehouse Bounce will do whatever possible to solve the problem or replace the defective equipment before the event ends. Failure to notify Firehouse Bounce of equipment problems may result in forfeiture of rental deposit and the full rental rate. Firehouse Bounce reserves a period of seventy-two (72) hours after the conclusion of this agreement to fully inspect the herein described equipment for damage, proper function or to determine if a cleaning charge will be applied.
Should Firehouse Bounce find any damage attributable to Lessee during the period that the equipment was in Lessee's sole care, custody and control, or if the equipment was returned in an unreasonably filthy state due to the use of prohibited substances including but not limited to confetti, glitter, foodstuffs, drinks, mud, sand, dog feces, etc., Firehouse Bounce will assess a $125.00 cleaning charge to the credit card used to pay the deposit immediately upon inspection. The use of “Silly String” is strictly forbidden in, on or around the rented equipment as it will permanently damage and ruin the material from which the unit is manufactured. If it is determined by Firehouse Bounce that the rented equipment/unit(s) have been damaged due to the use of this substance or for any other legitimate reason, Lessee will be liable for the cost of replacement of the unit(s) including any lost rental income by Firehouse Bounce immediately upon receiving a certified demand letter from Firehouse Bounce dated as of the date of the initial rental by Lessee. Firehouse Bounce retains all right, title, and interest in and to the herein described equipment and therefore maintains the right to terminate this lease at any time and recover the herein described equipment if not promptly returned by Lessee when requested by Firehouse Bounce. Lessee shall be liable for any and all costs incurred by Firehouse Bounce in the recovery process. Failure to observe the terms in this contract, or failure to make payment, or failure to have Firehouse Bounce equipment available for return per agreement, shall make Lessee liable to Firehouse Bounce for an additional one day rental fee, per day, until all equipment is returned in proper working order. This includes any additional court, legal and/or attorney fees incurred in order to obtain return of the rented property.
4.) Cancellations: If Lessee notifies Firehouse Bounce outside seven (7) days of the date of reservation that a cancellation is necessary, Firehouse Bounce will honor the request for the refund of any deposit or payment in full. Such refund would be issued 7 – 10 business days from the receipt of the request. Firehouse Bounce will not issue a refund for any cancellation request received inside seven (7) days of the date of reservation, however consideration will be made by Firehouse Bounce at its sole discretion to apply a credit to the Lessee account to be used for a future rental of Inflatable Equipment.
5.) Inclement Weather Policy: (A.) Firehouse Bounce will make every effort to ensure that every delivery is made as agreed, however, Texas weather can be unpredictable and the safety of the attendees is the primary concern of Firehouse Bounce. Therefore, Firehouse Bounce will closely monitor the weather forecast for the agreed rental date. If the forecast calls for inclement weather, including but not+ limited to rain, lightning, hail, wind speeds exceeding the Unit’s manufacturer’s guidelines, (and/or 20 MPH) – or if it has recently rained and the unit(s) cannot be safely set up due to standing water or other inherent dangers, or if in the judgment of Firehouse Bounce the risk of proceeding with the event would prove to be unsafe, Firehouse Bounce reserves the right to cancel the event without prior notice. Firehouse Bounce will however make every effort to communicate the decision with the Lessee as soon as it is practical. (B.) If Lessee and Firehouse Bounce agree to cancel the scheduled event PRIOR TO the delivery of the rented inflatable Unit(s), a full refund of any deposit amount or payment in full will be issued to Lessee within 7 to 10 business days. (C.) If Lessee and Firehouse Bounce agree to proceed with the scheduled event due to an apparent break in weather or window of opportunity and if in the judgment of Lessee and Firehouse Bounce, it is safe to proceed with the scheduled event, NO REFUND OF ANY KIND WILL BE ISSUED TO LESSEE AFTER DELIVERY OF THE UNIT FOR ANY REASON WHATSOEVER.
6.) Release of Liability: I (We) represent that I (We) am/are the responsible party and/or parent and/or legal guardian of the participant(s) or individual(s) for said party or event named below, or I (We) have obtained permission from the parent/legal guardian of the participant(s) or individual(s) for said party or event named below to execute this agreement on their behalf. I (We) agree that the participant(s) or individual(s) for said party or event named below and I (We) shall comply with all stated and customary terms, posted safety signs, rules and verbal instructions as conditions for participation in, on or around the inflatable equipment leased from Firehouse Bounce. In addition, if I (We) observe any hazard during our participation, I (We) will bring it to the attention of Firehouse Bounce and/or the individual that rented the inflatable equipment or is in charge of the inflatable equipment immediately.
I (We) am aware that there are inherent risks associated with participation in, on or in close proximity to a bounce house and/or inflatable slide equipment and I (We), on behalf of myself/ourselves and the participant(s) or individual(s) for said party or event named below, knowingly and freely assume all such risks, without recourse, both known and unknown, including those that may arise out of the negligence of other participants or individuals for said party or as a result of a manufacturer’s defect, or any occurrence either natural or man made, or any other act of God.
I (We), for myself/Ourselves and the participant(s) named below, and/or the party and/or event named below, our respective heirs, assigns, administrators, personal representatives, and next of kin hereby release and hold harmless, FHB Entertainment, LLC. DBA Firehouse Bounce, their affiliates, officers, shareholders, agents, employees, other participants, and sponsoring individuals and agencies from and against all claims, injuries, liabilities or damages arising out of or related to our participation in any and all of Firehouse Bounce programs, activities, parties, inflatable equipment and the use of the inflatable equipment.
7.) Returned Check Policy: If a check used to pay for a deposit or full rental rate is returned as unpaid by Lessee’s bank, the amount of the check, plus an additional $45.00 service charge must be paid in cash immediately upon notification to Lessee. If cash payment is not received within ten (10) days of notification of Lessee, the check will be turned over to the Court in that jurisdiction for collection of all outstanding fees and any additional fees, including attorney fees and court costs.
8.) Final Agreement/No Oral Agreements: By signing this Rental Contract, it is the intent of all parties to enter into a legally binding and enforceable contract. All parties agree that the terms of the Rental Contract are to be construed in accordance with Texas law. All parties also agree that any litigation between the parties concerning this agreement shall be filed in Rockwall County, Texas. Lessee acknowledges and certifies that he or she has had sufficient opportunity to read this entire agreement and the attached "General Rules of Operation", that Lessee has executed this document freely, intelligently and without any duress of any kind and that Lessee agrees to be bound by its terms; and finally that this contract sets forth the entire agreement between Lessee and Firehouse Bounce. There are no Oral Agreements.
